Die prozessrechtliche Abteilung des 70. Deutschen Juristentags beschäftigt sich mit der Frage, ob ZPO und GVG noch zeitgemäß sind, um den gewandelten Anforderungen an den Zivilprozess Genüge tun zu können. Die Fragestellung ist für unser Rechtssystem hoch bedeutend. Der gleiche Zugang zu Gericht, die Chancengleichheit und Fairness vor Gericht sowie die Schnelligkeit und Effizienz der Gerichtsverfahren sind für den Rechtsstaat schlicht konstitutiv.

Bagatellkriminalität und Unschuldsvermutung sind zwei Themenkomplexe, die zwar ursprünglich im Strafrecht verortet sind. Dass sie selbstverständlich gleichwohl auch im zivil- bzw. arbeitsrechtlichen Kontext relevant werden können, zeigt sich immer dann, wenn um die Wirksamkeit einer wegen einer solchen Bagatelltat ausgesprochenen Verdachtskündigung gestritten wird. Der Beitrag nimmt das Urteil des LArbG Berlin-Brandenburg gegen »Emily« zum Anlass, einerseits gegen eine »strafrechtliche Erheblichkeitsschwelle im Arbeitsrecht« zu argumentieren, andererseits aber die Bedeutung der Unschuldsvermutung im Arbeitsrecht hervorzuheben.

Biobanks represent key resources for clinico-genomic research and are needed to pave the way to personalised medicine. To achieve this goal, it is crucial that scientists can securely access and share high-quality biomaterial and related data. Therefore, there is a growing interest in integrating biobanks into larger biomedical information and communication technology (ICT) infrastructures. The European project p-medicine is currently building an innovative ICT infrastructure to meet this need. This platform provides tools and services for conducting research and clinical trials in personalised medicine. In this paper, we describe one of its main components, the biobank access framework p-BioSPRE (p-medicine Biospecimen Search and Project Request Engine). This generic framework enables and simplifies access to existing biobanks, but also to offer own biomaterial collections to research communities, and to manage biobank specimens and related clinical data over the ObTiMA Trial Biomaterial Manager. p-BioSPRE takes into consideration all relevant ethical and legal standards, e.g., safeguarding donors’ personal rights and enabling biobanks to keep control over the donated material and related data. The framework thus enables secure sharing of biomaterial within open and closed research communities, while flexibly integrating related clinical and omics data. Although the development of the framework is mainly driven by user scenarios from the cancer domain, in this case, acute lymphoblastic leukaemia and Wilms tumour, it can be extended to further disease entities.

Der Grundzweck dieser Arbeit besteht darin, durch die Kritik des deskriptiven und politischen Rechtspositivismus den Begriff des Rechtsprinzips vor dem neuen Hintergrund zu erläutern. Als Ziel der Hauptkritik wurde insbesondere Regeltheorie von H.L.A. Hart eingestellt. Der Verfasser versucht nämlich zu zeigen, wie die Hartscher „externer Beobachter“ in sich das Moment der Selbstentfremdung hat. Durch das Zeigen jenes Schwächepunktes ging der Verfasser darüber hinaus weiter dahin, zu zeigen, dass es im Bezug auf die Beobachtung der normativen Gegebenheit einer Lebenswelt keine solche „äußere Stelle“ gibt, worauf man quasi wie ein Naturwissenschaftler über seine Gegenstände rein wertneutrale Aussage machen kann. Aufgrund dieses Resultats schlägt der Verfasser den neuen Begriff des „hermeneutischen Raum“ vor. Dies ist nämlich originelle innere Perspektive der Beobachters eigenen Lebenswelt, derer außerhalb er auf keinem Augenblick stehen kann. Die Existenz jenes unsichtbaren Raums vergewissert sich man durch die ursprüngliche Existenz der generativen Regeln, also durch die innere Perspektive seiner Muttersprache. Aber nicht bloß durch jene schon rein konventionell bestehende innere Perspektive, sondern erst durch den aufgrund derer ausgeführten Sinngebungsakt des Teilnehmers selbst bildet sich der hermeneutische Raum weiter fort. Durch diese hintergründige Erläuterung stellt es sich heraus, dass das Rechtsprinzip generell demjenigen Richter im konkreten Lebenssachverhalt innerliche erscheinende normative Gegebenheit darstellt, der das System des positiven Rechts nicht bloß als System der rein konventionell gegebenen Regeln bzw. der Befehlen versteht, sondern durch die Sinngebung seiner eigenen Lebenswelt aktiv und reflexiv rekonstruiert. Aus diesem Grund besteht die Hauptaufgabe des aktuellen Richters nämlich darin, durch jene im konkreten Lebenskontext normative erscheinende innere Erfahrung im Licht auf ratio legis und ratio decidendi sprachlich auszudrücken. Insofern muss der im Grund positivistisch geprägte methodische Zwang der traditionellen Gewaltenteilungslehre, nach deren die richterliche Hauptaufgabe in der möglichst wertneutralen Anwendung der Absicht des Gesetzgebers bzw. Gesetzes auf die konkreten Fälle bestehe, letztendlich verzichtet werden. Dessen anstelle ist der Diskurs unter den Richtern in den Vordergrund einzutreten, der zur lebendigen Anwendung bzw. Fortbildung des reflexiv wiederhergestellten positiven Rechts auf den konkreten Lebenskontexten frei und transparent ausgeführt wird.

Europas Grenzen – Europas Anderes. Diese transdisziplinäre Arbeit zieht einen Bogen von Europas Grenzen zu Europas Anderem; Schwerpunkt ist dabei die Theorieentwicklung des Europarechts. Ausgangspunkt ist das Herausarbeiten der konzeptionellen Grenzen liberaler Rechtstheorie am Beispiel des deutschen Stranges liberaler Theorie von Kant nach Habermas mittels close reading (Teil 1). Dies wird ergänzt durch eine Beschreibung des Unionsrechts mit seinen zwei Ebenen (EU/Mitgliedstaaten) im doppelten Kontext der Vorstellungswelten von politischer Theologie und politischer Ökonomie (Teil 2). Der Ansatz der kulturellen Rechtstheorie mit seinem Standpunkt der Rechtsdurchsetzung wird dabei erweitert durch einen Blickwinkel „von unten“, d. h. aus der Sicht des Rechtssubjekts, und die Anwendung radikaler Theorien. Es entsteht eine Beschreibung der drei Dimensionen des Rechts und zugleich des europäischen politischen Denkens (Konservatismus, Liberalismus und Marxismus, Dreieck KLM). Abschließend wird mittels der Entwicklung einer psychoanalytischen Ideologiekritik nach Lacan, Althusser und Žižek Ideologie als vierte Dimension des Rechts beschrieben (Teil 3). Die EU-Grundrechtecharta mit ihrer doppelten Anrufung des europäischen Rechtssubjekts (als Unionsbürger/Staatsbürger eines Mitgliedsstaates und als Arbeitskraft) prägt zusammen mit dem Raum der Freiheit, der Sicherheit und des Rechts als „Raum ohne rechtsfreie Räume“ die European Lawscape, in der das Genießen des Rechts das Genießen der Nation bzw. des Politischen abgelöst hat. Ausgehend von den konzeptionellen Grenzen Europas erweist sich so der Flüchtling als idealer Anderer der europäischen Rechtsgemeinschaft, während die Roma, die sans papiers und die Armen/wirtschaftlich Überflüssigen, der „Teil ohne Anteil“, Europas reale(s) Andere(s) sind.
Europe’s Boundaries – Europe’s Other. This transdisciplinary paper draws a connection between Europe’s Boun- daries and Europe’s Other; its main focus lies on the development of the theory of European Law/European legal theory. As a starting point, the conceptual boundaries of liberal legal theory are carved out by means of close reading using the example of the German lineage of liberal theory from Kant to Habermas (part 1). This is comple- mented by a description of EU Law with its two levels (EU/member states) in the double context of the realms of perception of political theology and political economy (part 2). The approach of cultural legal theory with its standpoint of law enforce- ment is thereby enhanced by a bottom-up perspective, i. e. the perspective of the legal subject, and the application of radical theories. This evolves into an account of the three dimensions of law and simultaneously of European political thought (conservatism, liberalism and marxism, triangle CLM). Finally, ideology is described as the fourth dimension of law by means of developing a psychoanalytical critique of ideology drawing upon Lacan, Althusser and Žižek (part 3). The EU Charta of Fundamental Rights with its double invocation of the European legal subject (as EU citizen/citizen of a member state and as part of the workforce) together with the Area of freedom, justice and security as an „area without normative voids“ shape the European Lawscape, in which the enjoyment of the nation resp. the political is replaced by the enjoyment of the law. Emanating from the conceptual boundaries of Europe the refugee shapes up as the ideal Other of the European Community of law, whereas the Roma, the sans papiers and the poor/the economically dispensable, the „part without part“, turn out to be Europe’s real Other(s).

Das grundsätzlich dem Urheber zustehende Vervielfältigungsrecht findet gemäß § 53 UrhG beim Vorliegen bestimmter Voraussetzungen eine Einschränkung in Bezug auf Vervielfältigungen zum privaten oder sonstigen eigenen Gebrauch. Als Ausgleich für diesen Rechtsverlust sind in den §§ 54 ff. UrhG Vergütungsansprüche (eine Kombination von Geräte-, Medien- und Betreiberabgabe) zugunsten der Urheber vorgesehen.
Bisherige Untersuchungen zur Entwicklung dieses Vergütungssystems beziehen sich zumeist nur auf einzelne Entwicklungsstadien und nicht auf den gesamten Entwicklungszeitraum oder lassen hinsichtlich der Darstellung und Analyse der Gesamtentwicklung eine detaillierte Auseinandersetzung mit den Argumenten, die im Rahmen der die Entwicklung begleitenden Diskussionen vorgetragen wurden, sowie den verschiedenen Entwurfsstadien vermissen. Beides ist jedoch notwendig, um die Entwicklung des Systems voll erfassen und würdigen zu können.
Es wird daher die Entwicklung des Vergütungssystems von den ersten Diskussionen zum Gesetz betreffend das Urheberrecht an Werken der Literatur und der Tonkunst (LUG) in den 1950 Jahren bis zu dessen heutiger Ausgestaltung dargestellt und losgelöst von den späteren tatsächlichen Entwicklungen analysiert. Neben einem Blick auf die Entwicklungen in der Bundesrepublik Deutschland erfolgt ein Blick auf die europäische Ebene in Form einer Darstellung und Analyse der dort im Hinblick auf die Vergütungssysteme der Mitgliedsstaaten relevanten Entwicklungen und eine Untersuchung der Auswirkungen dieser auf das deutsche Vergütungssystem. Der Schwerpunkt liegt dabei auf der Richtlinie2001/29/EG und der zu dieser ergangenen Rechtsprechung des EuGH. Basierend auf den vorherigen Untersuchungsergebnissen erfolgt ein Ausblick in Bezug auf die mögliche künftige Ausgestaltung des Vergütungssystems mit einem konkreten Anpassungsvorschlag. Dieser hat unter anderem die künftige Erfassung von Cloud- Speicherdiensten durch das Vergütungssystem zum Gegenstand.
Die Untersuchung zeigt, dass bereits im Rahmen der ersten Diskussionen in den 1950 Jahren und der in diesem Zusammenhang ergangenen höchstrichterlichen Rechtsprechung Vorgaben entwickelt wurden, die nicht nur für die Anfänge des gesetzlich geregelten Vergütungssystems von Relevanz waren, sondern es auch noch heute sind. Zudem zeigt sie, dass seit mehr als 30 Jahren keine wesentliche Überarbeitung der Vergütungsansprüche stattgefunden hat. Daher existieren grundlegende Defizite, die bereits seit über 30 Jahren bestehen, auch heute noch. Dies ist insbesondere im Hinblick auf neue Geschäftsmodelle, in deren Rahmen relevante Vervielfältigungen erfolgen und die über die bestehenden Vergütungsansprüche kaum oder gar nicht zu erfassen sind, problematisch. Außerdem zeigt die Untersuchung, dass die bisherige Entwicklung des Vergütungssystems insgesamt einen Trend erkennen lässt, nach dem die Rechte der Urheber zu Gunsten der Vergütungsschuldner nicht immer angemessen zur Geltung kamen und auch weiterhin kommen. Dies stellt nicht nur einen Verstoß gegen die dem Grundgesetz zu entnehmenden Vorgaben dar, sondern ist darüber hinaus auch problematisch in Bezug auf die Vorgaben der Richtlinie 2001/29/EG.
Erforderlich sind daher wesentliche Änderungen der gesetzlichen Regelungen. Konkret zu nennen sind beispielsweise die Einführung von gesetzlichen Rückerstattungsansprüchen sowie die Berücksichtigung von Eigenarten bestimmter Nutzer der vergütungsrelevanten Geräte und Medien. In a noteworthy essay entitled "The Operation Called Vergleichen (Comparison)" Joachim Matthes has drawn attention to the fact that studies which claim to compare particular phenomena from one's own culture (such as law or administration, for example) with those of an alien culture do not, strictly speaking, perform a real comparison. Instead, what takes place is (in his words) a " nostrification", that is, " an appropriation of the other in one's own terms" or conceptual assimilation. Even the ideal-type constructions of Max Weber seem largely to confirm this proposition. In principle, then, it ought to be quite hard to find studies which are not exposed to the charge of nostrification. In what follows works by Gerd Spittler are examined in some detail from this particular perspective. In the first instance Spittler investigated the specific problems encountered by the colonial administration in West African peasant states (1919-39), before examining if this problematic could be applied to the peasant state of Prussia in the 18th century. So, for example, he asked himself how a bureaucratic administration reliant on written documents resolved the problem of raising taxes on a body of untruly peasants who to a large extent communicated orally amongst themselves. Since in both cases Spittler relates the typical structures of an agrarian society to typical administrative structures, he attains a level of reflection where the "One" can be translated into the "Other" and vice versa' (Matthes), and in this way he escapes the particular danger of nostrification.

Die Digitalisierungs- und Big Data-Bewegung wirkt sich auch auf die Versicherungsbranche erheblich aus. Die Flut an personenbezogenen Daten, die täglich generiert wird, und die Möglichkeiten, diese mittels Big Data Analytics-Methoden und KI-Anwendungen auszuwerten, ermöglichen nicht nur die Schaffung neuer Geschäftsmodelle in der Assekuranz. Vielmehr werden die neuen Technologien in allen Bereichen der Wertschöpfungskette entscheidende Veränderungen im Versicherungssektor bewirken. Eine der markantesten Entwicklungen ist die Möglichkeit, mit Big Data Analytics-Methoden das Versicherungsrisiko immer genauer zu bestimmen und Versicherungstarife entsprechend anzupassen bzw. zu individualisieren. Der Einsatz von hybriden Systemen mit einem hohen Automatisierungsgrad für das Massengeschäft und manueller Sachbearbeitung bei individuellen Leistungen ist ein weiterer Haupttrend im Versicherungssektor. Es zeichnet sich auch eine Entwicklung dahingehend ab, dass Versicherungsprodukte nicht nur als Risikoabsicherung angeboten, sondern in ein Servicepaket eingebunden werden, welches für den Kunden maßgeschneidert ist und diverse Dienstleistungen enthält. Der Untersuchungsgegenstand dieses Gutachtens bezieht sich auf einen wesentlichen Kernbestandteil der Digitalisierungsentwicklung im Versicherungsbereich: die Verwendung von Profiling-Verfahren und den Einsatz von automatisierten Einzelentscheidungen. Dazu werden die verschiedenen Zwecke für Profiling und automatisierte Einzelentscheidungen im Versicherungsbereich herausgearbeitet, wobei auch die spezifischen Chancen und Herausforderungen für Versicherer und Versicherte durch den vermehrten Einsatz entsprechender Verfahren dargelegt werden. Die rechtlichen Anforderungen an den Einsatz von Profiling-Verfahren und automatisierten Einzelentscheidungen werden im Anschluss untersucht. Dabei wird ein Schwerpunkt durch die Regelungen aus der Datenschutz-Grundverordnung (DS-GVO) zum Recht der betroffenen Person aus Art. 22 DS-GVO, keiner automatisierten Einzelentscheidung unterworfen zu werden, gebildet. Auch die Informationsobliegenheiten nach Art. 13 (2) lit. f und Art. 14 (2) lit. g DS-GVO und das Recht auf Auskunft gem. Art. 15 (1) lit. h DS-GVO werden eingehend analysiert. Des Weiteren bilden die Vorschriften des Allgemeinen Gleichbehandlungsgesetzes (AGG) einen weiteren Untersuchungsgegenstand. Zur Abrundung der Praxisanalyse werden im Hinblick auf den Umgang mit automatisierten Einzelentscheidungen die aktualisierten Verhaltensregeln des Gesamtverbands der Deutschen Versicherungswirtschaft e. V. (GDV) sowie diverse Datenschutzinformationen, die von Versicherungsunternehmen im Netz veröffentlicht wurden, beleuchtet. Anschließend wird mit Bezug auf die Praxis diskutiert, ob die vorhandenen Regelungen hinsichtlich der festgestellten Gefahren und Nachteile für die betroffenen Personen als ausreichend zu betrachten sind und welche weiteren Regelungs- bzw. Kontrollmöglichkeiten in Betracht kommen.

Das moderne Kraftfahrzeug benötigt und produziert eine Vielzahl an Daten und durch das Internet wird es mit anderen Entitäten vernetzt. Ziel ist u.a. das Fahrerlebnis zu verbessern und Arbeitsprozesse zu effektiveren. Das Erstellen von Bewegungs-, Nutzungs- oder Kommunikations-profilen ist u.a. für Marketingzwecke und die Versicherungsbranche von großem Interesse. Das Fahrzeug selbst wird zunehmend autonomer und die im Wagen integrierte Software trifft automatisierte Einzelentscheidungen, etwa bei der Modifikation von Fahrbefehlen aus Sicherheitsgründen oder beim automatisierten Notfallruf.
Diese Entwicklung wirft viele rechtliche Fragen auf. Das Gutachten behandelt insbesondere datenschutzrechtliche Fragstellungen und ordnet die Grundlagen zuvor in den Kontext der seit Mai 2018 anwendbaren EU-Datenschutz-Grundverordnung (EU-DSGVO) ein:
Sind alle Daten, die durch das Fahrzeug generiert bzw. durch Sensoren aufgenommen werden, personenbezogen? Welchen Einfluss hat dies auf die Frage der Nutzungsberechtigung? Wer ist eigentlich verantwortliche Stelle? Gibt es eine Mehrheit von Verantwortlichen? Verschiedene Beteiligte – z.B. Hersteller, Werkstatt, Arbeitgeber, Fuhrparkbetreiber, Softwareanbieter, staatliche Stellen – haben hier (berechtigte) Interessen an den Daten. Welche Anforderungen sind an die Hersteller der Kraftfahrzeuge aufgrund des nun in der Verordnung gesetzlich festgelegten Privacy by Design-Grundsatzes (Art. 25 DSGVO) zu stellen? Danach müssen die Verantwortlichen technische und organisatorische Maßnahmen sowie Verfahren einführen, die gewährleisten, dass die Vorschriften der Datenschutz-Grundverordnung eingehalten werden. Standardeinstellungen von Verarbeitungsverfahren sollen sicherstellen, dass nur so viele personenbezogene Daten wie nötig verarbeitet werden. Das Prinzip Privacy by Default ist bislang von sämtlichen Anbietern nicht sonderlich beachtet worden.
Zudem wurde auch die Gestaltung der entsprechenden Einwilligungsmodelle untersucht, wobei hier Fragen der Informiertheit und Freiwilligkeit eine Rolle spielen. Inwiefern neue Umsetzungsstrategien für das Instrument der informierten Einwilligung genutzt werden können, um diese wieder zunehmend als ein Instrument der informationellen Selbstbestimmung zu erachten, wurde analysiert. Zudem stellt sich das Problem, wie die Daten von Mitfahrern oder Gelegenheitsfahrern, welche zu den verantwortlichen Stellen in keinerlei Beziehung stehen, zu handhaben sind? Wie kann Transparenz für die Betroffenen geschaffen werden? Eingehend werden auch die Rechtsgrundlagen der Verarbeitung behandelt, die im Kontext des smart Cars sehr unterschiedlich ausgestaltet werden können. Außerdem werden die Porblematiken der automatisierten Eintscheidungsfindung angesprochen sowie die Problematik des sog. „function creeps“.

The Lisbon Treaty added a new article to the EU primary legislation (Art. 222 TFEU also referred to as the Solidarity Clause) which requires solidarity between the EU and its Member States in crisis situations brought about by natural or man-made hazards and terrorist attacks. At the same time, solidarity remains a vague legal concept and the EU is struggling to develop joint solidary policies, e.g. in response to the economic and financial crisis and most recently with respect to asylum and immigration in the context of the refugee crisis. This gives the impression that solidarity is less a political reality than mere wishful thinking. Consequently, the character and intention of primary legislation referring to solidarity remains rather confusing. Have respective norms been created to build a basis for joint efforts and
concrete measures in the respective policy fields, or are they insubstantial statements narratively adding to what the Union should be? This question is at the core of this work. The thesis analyses how solidarity is conceptualised at different levels (national and EU) and in different contexts (normal conditions vs. crisis) and relates it to Art. 222 TFEU to finally put these aspects into context of civil protection as an important policy field for the conceptualisation of political entities.

This paper provides an overview on the most relevant legal, ethical and social implications arising from the use of computational intelligence based systems for land border crossings. Based on the automatic deception detection system (ADDS) developed in the iBorderCtrl project, issues such as the peculiarities of the interaction of humans with machines, profiling, automated decision-making and the risk of false positives can be identified and demonstrate how computational intelligence based systems can challenge fundamental legal and ethical principles. These include in particular the right to privacy, human dignity and the principle of non-discrimination. By further analysing the various issues, this paper seeks to provide some thoughts on remedies and safeguards which should be considered when developing computational intelligence based systems.© 2018 IEEE. Die DSM-RL ist ein Eckpfeiler des ambitionierten Vorhabens der EU das Urheberrecht zu modernisieren. Die Reaktion auf neue Geschäftsmodelle, die zu einer massenhaften Nutzung von- und Zugangsvermittlung zu urheberrechtlich geschützten Inhalten im Internet beigetragen haben, ist dabei ein Quell der Bestrebungen. Denn Dienste wie YouTube, Google oder Facebook generieren ihre Wertschöpfung mittelbar über Inhalte Dritter während Urheber vor den Schwierigkeiten der Rechte- und Interessendurchsetzung im Internet stehen. Zur Schaffung eines funktionsfähigen Marktes in diesem Bereich sind daher in Titel IV des Richtlinienentwurfs Bestimmungen vorgesehen, welche der Stärkung von Rechteinhabern gegenüber Dienstanbietern dienen sollen. Bei den wohl umstrittensten dieser Vorschriften handelt es sich um das Leistungsschutzrecht von Presseverlegern, Artikel 15 DSM-RL, einerseits sowie um die Pflichten von Online-Diensteanbietern für bestimmte Nutzung von geschützten Inhalten, Artikel 17 DSM-RL, andererseits. Der Beitrag analysiert diese Vorschriften mit Blick darauf, ob und inwieweit sie dem intendierten Zweck eines Interessenausgleichs zwischen den Rechteinhabern, Dienstanbietern und nicht zuletzt Nutzern gerecht werden und gleichsam mit dem sonstigen nationalen und europäischen Recht in Einklang stehen. Gleichsam werden mögliche Umsetzungsansätze aufgeworfen, welche insbesondere im Lichte des jüngsten Gesetzesentwurfs zur Umsetzung der DSM-RL in nationales Recht, als Stimulus dienen können.

Background Health information systems have developed rapidly and considerably during the last decades, taking advantage of many new technologies. Robots used in operating theaters represent an exceptional example of this trend. Yet, the more these systems are designed to act autonomously and intelligently, the more complex and ethical questions arise about serious implications of how future hybrid clinical team-machine interactions ought to be envisioned, in situations where actions and their decision-making are continuously shared between humans and machines. Objectives To discuss the many different viewpoints-from surgery, robotics, medical informatics, law, and ethics-that the challenges of novel team-machine interactions raise, together with potential consequences for health information systems, in particular on how to adequately consider what hybrid actions can be specified, and in which sense these do imply a sharing of autonomous decisions between (teams of) humans and machines, with robotic systems in operating theaters as an example. Results Team-machine interaction and hybrid action of humans and intelligent machines, as is now becoming feasible, will lead to fundamental changes in a wide range of applications, not only in the context of robotic systems in surgical operating theaters. Collaboration of surgical teams in operating theaters as well as the roles, competencies, and responsibilities of humans (health care professionals) and machines (robotic systems) need to be reconsidered. Hospital information systems will in future not only have humans as users, but also provide the ground for actions of intelligent machines. Conclusions The expected significant changes in the relationship of humans and machines can only be appropriately analyzed and considered by inter- and multidisciplinary collaboration. Fundamentally new approaches are needed to construct the reasonable concepts surrounding hybrid action that will take into account the ascription of responsibility to the radically different types of human versus nonhuman intelligent agents involved.

The COVID-19 pandemic has raised significant concerns for population mental health and the effective provision of mental health services in the light of increased demands and barriers to service delivery [1]. Particular attention is being directed toward the possible neuropsychiatric sequelae of both COVID-19 and of the stringent societal mitigation steps deployed by national governments, concerns that are informed by historical increases in the incidence of psychotic disorders following influenza pandemics [2]. However, so far there has been scant attention paid to other important areas of psychiatry during COVID-19, including medico-legal aspects and human rights. In this paper, we discuss the legal implications for psychiatry of the COVID-19 pandemic and report a novel situation in which psychiatric patients may experience diminution of their statutory protections. We believe that this represents a paradigm shift in psychiatric care and that the consideration of the fundamental rights of psychiatric patients as "less important" than infection control measures compel mental health professionals to "advocate for … patients and their caregivers" in this time of crisis [1].

This dissertation focuses on the risk assessment carried out as part of a data protection impact assessment (DPIA) under Article 35 of the General Data Protection Regulation (GDPR), particularly, Article 35 (7)(c). Conventionally, risk assessment is a process of risk management that aims to identify the potential threats against an asset or object of value, analyse the likelihood and severity of the threats and potential harms if they materialise, and evaluate the risk level with the ultimate objective of implementing measures to mitigate the identified risks. The current data protection framework in the EU has integrated a risk-based approach, requiring that risk assessment be conducted in several situations, including in the course of a DPIA. When this risk management feature is transposed to the context of data protection, the question then is how this process should be appropriately carried out to meet the requirements of the data protection law and retain its risk management characteristics? There is no mandatory methodology under the GDPR for this exercise. Published guidelines on DPIA by the supervisory authorities have not clarified the scope of this core process. In most of these guidelines, for example, there are no clear and systematic criteria for identifying data protection threats, analysing and evaluating the likelihood and severity of the risk, as well as how to measure the risk level. This uncertainty undoubtedly affects the use and practical relevance of these guidance documents, as well as the resultant DPIAs that are based on them.
Bearing in mind that the GDPR does promote consistency and requires an objective assessment of risk, would the mostly subjective and unsystematic approach to risk assessment be sustainable henceforth? How could more procedural transparency be devised in this exercise, and what impact will it have? This dissertation argues in favour of a more uniform and systematic approach to data protection risk assessment and posits that it is feasible to achieve given that the GDPR contains provisions that can be used to design this risk assessment architecture systematically. Existing risk management tools can be leveraged to accomplish this objective. What is missing, however, is a careful adaptation of these tools to suit the data protection environment. The study further argues that good practices in DPIA should be incentivised as a way of encouraging well-designed and implemented risk assessment.
This study, therefore, proposes a method of mapping the ISO 31000:2018 processes with the relevant GDPR requirements for a DPIA and further suggests a methodology for operationalising risk assessment in a systematic way. This approach not only exposes the steps of conducting risk assessment during a DPIA, but also makes it easy to identify and focus on relevant criteria for completing each step. Theoretically, this translates a DPIA into a procedural ‘tool of transparency’ as advanced by De Hert and Gutwirth’s theory of data protection.
In the end, several recommendations are made to relevant stakeholders on how to further achieve consistency in the application of risk assessment during a DPIA. The output of this study targets not only the data controllers and processors, who are eager to find the best method of complying with the DPIA obligation, but also the supervisory authorities, as it will be valuable in their review and audit functions. It also exposes parameters upon which these stakeholders can measure whether a risk assessment has been appropriately conducted. The broader privacy community will find the content of this study interesting in advancing their knowledge.

We discuss when law-invariant convex functionals “collapse to the mean”. More precisely, we show that, in a large class of spaces of random variables and under mild semicontinuity assumptions, the expectation functional is, up to an affine transformation, the only law-invariant convex functional that is linear along the direction of a nonconstant random variable with nonzero expectation. This extends results obtained in the literature in a bounded setting and under additional assumptions on the functionals. We illustrate the implications of our general results for pricing rules and risk measures. © 2021 The Author(s)

Der öffentlich-rechtliche Vertrag ist als Handlungsinstrument der Verwaltung im
klassischen Verwaltungsrecht von zunehmender Bedeutung. Auch im europäischen
Unionsrecht ist der öffentlich-rechtliche Vertrag mit dem ReNEUAL-Entwurf ver -
stärkt in das Bewusstsein der Fachöffentlichkeit gerückt. Im immer noch überwiegend
ordnungsrechtlich geprägten Öffentlichen Wirtschaftsrecht kommt ihm jedoch bislang
in vielen Teilbereichen eine eher untergeordnete praktische Bedeutung zu. In dem Bei-
trag wird nach einer einleitenden Darstellung der Entwicklungsstufen des Öffentlichen
Wirtschaftsrechts die Fortentwicklung der verwaltungsrechtlichen Handlungsformen-
lehre skizziert. Nach einer Abgrenzung von verwandten Handlungsformen werden
die Grundtypen des öffentlich-rechtlichen Vertrags aufgezeigt. Im Mittelpunkt des
Beitrags steht sodann eine aktuelle Analyse des öffentlich-rechtlichen Vertrags in den
einzelnen Bereichen des Öffentlichen Wirtschaftsrechts. Abschließend erfolgt ein aus-
blickendes Fazit.

For many decades, the clinical unmet needs of primary Sjögren's Syndrome (pSS) have been left unresolved due to the rareness of the disease and the complexity of the underlying pathogenic mechanisms, including the pSS-associated lymphomagenesis process. Here, we present the HarmonicSS cloud-computing exemplar which offers beyond the state-of-the-art data analytics services to address the pSS clinical unmet needs, including the development of lymphoma classification models and the identification of biomarkers for lymphomagenesis. The users of the platform have been able to successfully interlink, curate, and harmonize 21 regional, national, and international European cohorts of 7,551 pSS patients with respect to the ethical and legal issues for data sharing. Federated AI algorithms were trained across the harmonized databases, with reduced execution time complexity, yielding robust lymphoma classification models with 85% accuracy, 81.25% sensitivity, 85.4% specificity along with 5 biomarkers for lymphoma development. To our knowledge, this is the first GDPR compliant platform that provides federated AI services to address the pSS clinical unmet needs. © 2022 The Author(s)

Cybersecurity concerns have been at the forefront of regulatory reform in the European Union (EU) recently. One of the outcomes of these reforms is the introduction of certification schemes for information and communication technology (ICT) products, services and processes, as well as for data processing operations concerning personal data. These schemes aim to provide an avenue for consumers to assess the compliance posture of organisations concerning the privacy and security of ICT products, services and processes. They also present manufacturers, providers and data controllers with the opportunity to demonstrate compliance with regulatory requirements through a verifiable third-party assessment. As these certification schemes are being developed, various sectors, including the electrical power and energy sector, will need to access the impact on their operations and plan towards successful implementation. Relying on a doctrinal method, this paper identifies relevant EU legal instruments on data protection and cybersecurity certification and their interpretation in order to examine their potential impact when applying certification schemes within the Electrical Power and Energy System (EPES) domain. The result suggests that the EPES domain employs different technologies and services from diverse areas, which can result in the application of several certification schemes within its environment, including horizontal, technological and sector-specific schemes. This has the potential for creating a complex constellation of implementation models and would require careful design to avoid proliferation and disincentivising of stakeholders. © 2022 by the authors. Weber uses the term ‘logical’ with striking frequency: as a typical attribute of what is ‘rational’, but also in the definition of legal arrangements, where the ‘legally relevant components’ that characterise a legal relationship are ordered in a ‘manner which is itself logically free from contradiction’. Logic or logically significant characteristics are all features of the theoretical and academic doctrine of law, which stands as a contrasting type to the artisanal-empirical doctrine of the law of practitioners (represented by Roman and English law respectively). In this way logic or what is logical is an important sign of the difference between these two fundamental types of legal doctrine. Above all, logic and the logical play an outstanding role in Weber’s definition of a legal ‘system’ in the sense of ‘an assembly of all the legal propositions established by analysis in such a way that, taken all together, they form a system of rules that is itself logically free from contradiction and seamless in principle’. In this definition of ‘system’ Weber makes use of the postulates of so-called conceptual jurisprudence, something that did not exist in fact, but which originally signified a deliberate caricature (or criticism) of the science of the Pandects, of which Georg Friedrich Puchta (1798-1846) stood as the representative. He was selected because Rudolf von Jhering had Puchta mainly in mind when he framed the polemical idea of conceptual jurisprudence. Puchta was also singled out because he spoke, inter alia, of a ‘genealogy of concepts’, which encouraged the ascription of systemic qualities to his system of private law. Yet Weber omitted to test Puchta’s ‘system’ according to his own ideal-typical criterion of a system that ‘logically free from contradiction’ and ‘seamless in principle’. This deficiency will be remedied here.

Protection of creditors is a key objective of financial regulation. Where the protection needs are high, that is, in banking and insurance, regulatory solvency requirements are an instrument to prevent that creditors incur losses on their claims. The current regulatory requirements based on value at risk (V@R) and average value at risk (AV@R) limit the probability of default of financial institutions, but they fail to control the size of recovery on creditors' claims in the case of default. We resolve this failure by developing a novel risk measure, recovery V@R. Our conceptual approach is flexible and allows the construction of general recovery risk measures for various risk management purposes. We provide detailed case studies and applications. We show that recovery risk measures can be used for performance-based management of business divisions of firms and discuss how to calibrate recovery risk measures to historical regulatory standards. Finally, we analyze how recovery risk measures react to the joint distributions of assets and liabilities on firms' balance sheets and compare the corresponding capital requirements with the current regulatory benchmarks based on V@R and AV@R.

Pollitt and Bouckaert and their neo-Weberian state (NWS) have been chosen as the subject for this essay because the book has become a standard work in the public management movement. It is frequently cited and has been re-published in multiple editions (most recently in 2017). The authors also refer explicitly to Max Weber. This contribution seeks to draw attention to three important aspects, which inevitably overlap with one another: 1. There is no Weber in the neo-Weberian State (introduction, 1; section II). Pollitt and Bouckaert fail to grasp that Weber’s understanding of the state [the state as an “institution” (Anstalt); and the state as an “idea of validity” (Geltungsvorstellung)] is not identical to his ideal type of modern bureaucracy; it is the features of the latter on which they draw. The ideal type is a standard measure constructed in order to establish how close any concrete, given instance of bureaucracy comes to it (introduction, 3). Meanwhile, the “neutral official” insisted upon by Weber has “taken their leave” in Germany from important positions (section III, 3). Furthermore, Weber did not address those structures and processes internal to the administration which are precisely the object of interest for the new public management reformers. Weber’s lack of interest arises from the fact the members of an Anstalt, whether it is the state or the Church (WuG, § 15, no. 2), are subject to imposed orders (oktroyierte Ordnungen) and, as such, do not enjoy the “right to have a say”. Scharpf (1973a) was the first to pay particular attention to the problems brought about by specialisation and by the division of labour within the administration that are responsible for an incremental form of politics (section III, 3); even if he later ascribes advantages to the combination of “negative” and “positive coordination” (Scharpf 1991: 18ff.). 2. The “legalistic culture” that characterises Germany will be considered in a more differentiated way, drawing on empirical studies which provide information, for example, on how laws (i.e. programmes) actually originate inside the ministerial apparatus (introduction, 2; section III, 2 and 3) or how use is made of the power of authority (Weisungsrecht) in practice (introduction, 2; section III, 2 and 3), even when, formally, it claims to have validity (section III). In this way, only empirical studies (Benz 1994; Bohne 1981; Dose 1997; Dose/Voigt 1995; Treiber 2007a) prove that the administration that implements laws has often, in practice, become a “negotiative administration” (introduction, 2). Such a phenomenon as a “co-operative administration”, which negotiates rather than rules, is a “foreign concept” in Weber’s discussion of the state and modern bureaucracy. Scharpf’s (1970) comparison between constitutional governance in Germany and legal relief in America is enlightening when it comes to the meaning of the constitutional state (Rechtsstaat) (introduction, 2; section III); the same applies to his discussion of the failed federalist reforms, which sought, among other things, to mitigate, if not entirely eliminate, the opportunities for blockades provided by political entanglement (Politikverflechtung) (section III). Neither was it possible to realise long overdue proposals to reform administrative law (Verwaltungsrecht) (section III, 1), which involved weakening or removing altogether three important assumptions in the dominant administrative doctrine (the “dogmatic normality”) and which also included the ambitious intention for the law to achieve tangible impact (Hoffmann-Riem 1994). Nonetheless, while no-one would dispute that reform of the federal government and administration remained “on the agenda” (Scharpf 1991, Mayntz/ Scharpf 1973), the priorities of such a reform were, and still are, different to those of new public management reform [the key terms here are Planung (“planning”) and the term that replaced it, Steuerung (“management”)]1. 3. Pollitt and Bouckaert ascribe to the neo-Weberian state extremely varied functions without providing any (theoretical) basis for them. In this way, the notion of public management reform that they present acquires the status of a “reformist philosophy” (introduction, 3; section IV). See Scharpf (1991) for a theoretically well-founded argumentation on the State’s ability to act in our days. Scharpf’s essay will be discussed briefly (section IV). Conclusion There is no Weber in the neo-Weberian state. According to the discussion presented here, the neo-Weberian state can only mean: how would a modern state constituted by Weber look today?

Die rasanten Entwicklungen im Bereich der Künstlichen Intelligenz und Robotik stellen nicht nur die Ethik, sondern auch das Recht vor neue Herausforderungen, gerade im Bereich der Medizin und Pflege. Grundsätzlich hat der Einsatz von KI dabei das Potenzial, sowohl die Heilbehandlungen als auch den adäquaten Umgang im Rahmen der Pflege zu erleichtern, wenn nicht sogar zu verbessern. Verwaltungsaufgaben, die Überwachung von Vitalfunktionen und deren Parameter sowie die Untersuchung von Gewebeproben etwa könnten autonom ablaufen. In Diagnostik und Therapie können Systeme die behandelnde Ärztin unterstützen. Intelligente Betten ermöglichen eine Frühmobilisierung der Patient:innen bei gleichzeitig geringerem Personalaufwand. Gleichwohl birgt der Einsatz der Systeme rechtliche Herausforderungen. So besteht das Risiko einer Verletzung der beteiligten Personen. Im Gegensatz zu herkömmlichen Technologien „leidet“ KI unter der „Black-Box-Problematik“: Die von den Systemen generierten Ergebnisse sind nicht mehr vollständig vorhersehbar und nachvollziehbar. Der Einsatz birgt unbekannte und unkalkulierbare Risiken, was sich insbesondere auf die zivilrechtliche Haftung und strafrechtliche Verantwortung auswirkt. Wem die Entscheidungen der Systeme normativ zuzurechnen sind, ist eine Kernfrage des juristischen Diskurses. Die aus praktikabilitätsgründen naheliegende Wahl, dem letztentscheidenden Menschen das Verhalten eines KI-Systems zuzurechnen, überzeugt nicht in allen Fällen, sondern degradiert ihn häufig zum symbolischen Haftungsknecht und legt ihm einseitig die Risiken der Technologien auf. Weiterhin ergeben sich im Bereich der Medizin und Pflege Fragen hinsichtlich der Zulassung von KI-Systemen, da die Maschinen während der Nutzung weiterlernen und so ihren strukturellen Aufbau kontinuierlich verändern. Es ist daher angebracht, sich frühzeitig mit dem Konfliktpotential aus ethischer und rechtlicher Sicht auseinander zu setzen, um einer potenziellen gesellschaftlichen Angst vor derartigen Systemen vorzubeugen und einen praxisgerechten Handlungsrahmen zu schaffen.
Definition of the problem: Rapid developments in the field of artificial intelligence (AI) and robotics pose new challenges not only to ethics but also to law, especially in the field of medicine and nursing. In principle, the use of AI has the potential to facilitate, if not improve, both curative treatments and adequate handling in the context of care. Administrative tasks, the monitoring of vital functions and their parameters, and the examination of tissue samples, for example, could run autonomously. In diagnostics and therapy, such systems can support the attending physician. Intelligent beds make it possible to mobilize patients early while at the same time reducing the need for personnel. Nevertheless, the use of these systems poses legal challenges. For example, there is a risk of injury to the people involved. Unlike conventional technologies, AI “suffers” from the “black box problem”: the results generated by the systems are no longer fully predictable and comprehensible. Its use entails unknown and incalculable risks, with particular implications for civil liability and criminal responsibility. Arguments: To whom the decisions of the systems are normatively attributable is a core question of legal discourse. The obvious choice, for reasons of practicability, of attributing the behaviour of an AI system to the human being who makes the final decisions is not convincing in all cases, but often degrades the human being to a symbolic “liability servant” and imposes the risks of the technologies on the human being in a one-sided manner. Furthermore, in the field of medicine and care, questions arise regarding the approval of AI systems, since the machines continue to learn during use and thus continuously change their structural design. Since the systems require any amount of reliable data for training and later use—especially through further learning—adequate handling of personal data is also necessary with regard to data protection law in the area of care and medicine. Conclusions: It is therefore advisable to address the potential for conflict from an ethical and legal perspective at an early stage in order to prevent a potential social fear of such systems and to create a practical framework for action. Orientation towards the guiding principle of “meaningful human control” offers the potential to solve these challenges.

Die Thesis untersucht die Schutzgesetzeigenschaft kapitalmarktrechtlicher Vorschriften i.S.d. § 823 Abs. 2 BGB. Ziel ist es, die wesentlichen Argumentationslinien, welche die wissenschaftliche Diskussion um den Individualschutzcharakter prägen, auf ihre Güte und Reliabilität zu überprüfen. Im Fokus stehen dabei insbesondere die europarechtlichen Implikationen für den Schutzgesetzeigenschaft kapitalmarktrechtlicher Normen. Mit der Arbeit soll die Forschungsfrage beantwortet werden, inwieweit der Durchsetzungsmechanismus aus § 823 Abs. 2 BGB den Anforderungen des Kapitalmarktrechts gerecht werden und ein geeignetes Instrument für einen – vorschnell? – postulierten Paradigmenwechsel sein kann.

Gegenstand dieser Arbeit ist die Analyse von Bedingungen, die den Einsatz von Computern im Rahmen juristischer Entscheidungsprozesse erschweren oder erleichtern. Auf der Grundlage der bestehenden juristischen Entscheidungstechnik wird versucht, einen traditionell ausgebildeten Juristen schrittweise an die methodologischen Probleme heranzuführen und bestimmte systemimmanente Lösungsstrategien aufzuzeigen.
Zahlreichen Personen, die mich durch Rat und Tat, Anregung und Kritik, Diskussion und Ermunterung bei der Arbeit unterstützt haben, möchte ich an dieser Stelle herzlich danken. Sie alle zu erwähnen ist nicht möglich, und nur einige zu nennen wäre ungerecht. This paper presents a framework for research infrastructures enabling ethically sensitive and legally compliant data science in Europe. Our goal is to describe how to design and implement an open platform for big data social science, including, in particular, personal data. To this end, we discuss a number of infrastructural, organizational and methodological principles to be developed for a concrete implementation. These include not only systematically tools and methodologies that effectively enable both the empirical evaluation of the privacy risk and data transformations by using privacy-preserving approaches, but also the development of training materials (a massive open online course) and organizational instruments based on legal and ethical principles. This paper provides, by way of example, the implementation that was adopted within the context of the SoBigData Research Infrastructure.

Based on classical contagion models we introduce an artificial cyber lab: the digital twin of a complex cyber system in which possible cyber resilience measures may be implemented and tested. Using the lab, in numerical case studies, we identify two classes of measures to control systemic cyber risks: security- and topology-based interventions. We discuss the implications of our findings on selected real-world cybersecurity measures currently applied in the insurance and regulation practice or under discussion for future cyber risk control. To this end, we provide a brief overview of the current cybersecurity regulation and emphasize the role of insurance companies as private regulators. Moreover, from an insurance point of view, we provide first attempts to design systemic cyber risk obligations and to measure the systemic risk contribution of individual policyholders.

Making good decisions in extremely complex and difficult processes and situations has always been both a key task as well as a challenge in the clinic and has led to a large amount of clinical, legal and ethical routines, protocols and reflections in order to guarantee fair, participatory and up-to-date pathways for clinical decision-making. Nevertheless, the complexity of processes and physical phenomena, time as well as economic constraints and not least further endeavours as well as achievements in medicine and healthcare continuously raise the need to evaluate and to improve clinical decision-making. This article scrutinises if and how clinical decision-making processes are challenged by the rise of so-called artificial intelligence-driven decision support systems (AI-DSS). In a first step, this article analyses how the rise of AI-DSS will affect and transform the modes of interaction between different agents in the clinic. In a second step, we point out how these changing modes of interaction also imply shifts in the conditions of trustworthiness, epistemic challenges regarding transparency, the underlying normative concepts of agency and its embedding into concrete contexts of deployment and, finally, the consequences for (possible) ascriptions of responsibility. Third, we draw first conclusions for further steps regarding a 'meaningful human control' of clinical AI-DSS.
