Durch die Schaffung des Rechtsinstituts der rechtlichen Betreuung hat der deutsche Gesetzgeber einen Teil seiner aus dem Sozialstaatsprinzip abzuleitenden Pflicht, Sorge für hilfsbedürftige Bürger zu tragen, auf Einzelpersonen übertragen. Die daraus entstandene Verantwortung zur Überwachung der rechtlichen Betreuer im Rahmen der Vermögenssorge sollte im Rahmen dieser Arbeit auf ihre Funktionsweise und Wirksamkeit untersucht werden. Dazu wurde das Betreuungsrecht vor und nach dem Gesetz zur Reform des Vormundschafts- und Betreuungsrechts vom 04.05.2021 analysiert. Ergänzt wurden die so gewonnenen Erkenntnisse durch eine empirische Untersuchung von Betreuungsbehörden-, Betreuungsgerichts- und Strafakten. Die vorhandenen Kontrollinstrumente im Betreuungsrecht sind sowohl vor als auch nach der genannten Reform lückenhaft und lassen tatgeneigten Betreuern die Chance, sich am Vermögen der von ihnen betreuten Personen zu bereichern. Gerade bei familiären-ehrenamtlichen Betreuern zieht sich der Staat aus der Fürsorgeverantwortung zurück. Die empirische Untersuchung zeigte keine ausreichenden Unterschiede zwischen beruflichen Betreuern und familiären-ehrenamtlichen Betreuern, die die festgestellten Unterscheidungen in der Kontrolldichte rechtfertigen könnten.; By creating the legal institution of legal guardianship (Rechtliche Betreuung), the German legislator has transferred part of its duty, derived from the welfare state principle, to care for citizens in need of assistance to individuals. The resulting responsibility to monitor legal guardians (Rechtliche Betreuer) in the context of asset management was to be examined for its functionality and effectiveness in the context of this thesis. To this end, the guardianship law before and after the act on the reform of guardianship law (Gesetz zur Reform des Vormundschafts- und Betreuungsrechts) of 04.05.2021 was analyzed. The findings were supplemented by an empirical study of files of guardianship authorities, guardianship courts and criminal courts. The existing control instruments in guardianship law are insufficient both before and after the above-mentioned reform, and give caregivers who act in bad faith the opportunity to enrich themselves with the assets of the people they care for. The state is withdrawing from its responsibility to provide care, particularly in the case of family-based voluntary guardians. The empirical study did not reveal any sufficient differences between professional legal guardians and family-based voluntary guardians to justify the differences in the level of control that were identified.

Building resilience in cybersecurity: An artificial lab approach

Based on classical contagion models we introduce an artificial cyber lab: the digital twin of a complex cyber system in which possible cyber resilience measures may be implemented and tested. Using the lab, in numerical case studies, we identify two classes of measures to control systemic cyber risks: security- and topology-based interventions. We discuss the implications of our findings on selected real-world cybersecurity measures currently applied in the insurance and regulation practice or under discussion for future cyber risk control. To this end, we provide a brief overview of the current cybersecurity regulation and emphasize the role of insurance companies as private regulators. Moreover, from an insurance point of view, we provide first attempts to design systemic cyber risk obligations and to measure the systemic risk contribution of individual policyholders.

An ethico-legal framework for social data science

This paper presents a framework for research infrastructures enabling ethically sensitive and legally compliant data science in Europe. Our goal is to describe how to design and implement an open platform for big data social science, including, in particular, personal data. To this end, we discuss a number of infrastructural, organizational and methodological principles to be developed for a concrete implementation. These include not only systematically tools and methodologies that effectively enable both the empirical evaluation of the privacy risk and data transformations by using privacy-preserving approaches, but also the development of training materials (a massive open online course) and organizational instruments based on legal and ethical principles. This paper provides, by way of example, the implementation that was adopted within the context of the SoBigData Research Infrastructure.
